Will Storage

Your Will is an important legal document and needs to be stored correctly. If it is not, then there is a risk it could be deemed invalid. This can happen as a result of something as simple as having a paper clip accidentally attached to it or as a result of something more serious such as water damage.

How is my Will stored?

At Specters, we can store your Will free of charge if you have already instructed us to write or review your Will. We will ensure that your Will is stored correctly to protect against unfortunate accidents like fire and water damage.

When your Will is created, we can on your instruction inform all named Executors of where it is stored so that they are prepared for when you pass away.

When clients store their Will with us, they are provided with a photocopy for their own reference and records.

It is a good idea to store your Will with us because problems can arise from storing it yourself. When people choose to store their Will themselves, they may choose to use a safety deposit box; this can lead to big problems. The problem is that when someone passes away, a bank is unable to open the safety deposit box unless the Executor gets Probate; and you cannot get Probate without a Will!

How is a Will retrieved?

You are able to collect your original Will from storage with us at any time and free of charge. All we require in order to retrieve your Will for you is a copy of your photo ID and for you to sign a receipt confirming we have released your original Will.

If a client passes away and the Will needs to be released, we require the following before we can do this:

• Original death certificate
• A copy of each Executor’s photo ID
• Receipt signed by all named Executors to confirm the release of the Will

All of these steps are explained to you at the time of making or reviewing your Will.
